These Terms of Service ("Terms") govern your access to and use of services provided by Andy Web Service ("AWS", "we", "us"). By signing up, placing an order, or otherwise using our services, you agree to be bound by these Terms. If you do not agree, do not use the services.

Eligibility

You must be at least 18 years old, or otherwise hold legal capacity in your jurisdiction, to register for and use our services. By using the services you represent that you meet this requirement and that the information you provide during registration is accurate and complete.

Services

We offer KVM cloud servers, dedicated servers, server colocation, and related infrastructure services in Hong Kong and Singapore. Service specifications, regions, and prices are as published on our customer portal at idc.andyws.io and may be revised from time to time.

Violations may result in immediate suspension or termination of service without refund. We cooperate with lawful requests from competent authorities.

Billing & Payment

Services are billed in advance on a monthly, quarterly, or annual cycle as selected at checkout. Invoices become due on the date issued. Overdue invoices may trigger automatic suspension after a 7-day grace period and, after a further 14 days, automatic termination and deletion of data.

Prices are exclusive of any applicable taxes. We accept Stripe, PayPal, Alipay, USDT, and bank transfer. Refunds, where granted, are issued to the original payment method.

Refund Policy

New KVM cloud services qualify for a full refund within 7 days of first activation, provided the service has not been subject to abuse, suspension, or fair-use violation. Dedicated servers, colocation, custom builds, IP space, software licenses, and domain registrations are non-refundable.

Service Levels

We target 99.9% monthly uptime for the underlying network and hypervisor. Scheduled maintenance windows, attacks targeting a customer's own service, and force-majeure events are excluded from uptime calculations. Service credits, where applicable, are issued at our discretion and capped at the affected month's fees.

Data & Backups

You are responsible for your own data. Default services do not include automated off-site backups; snapshot features, where available, are retained on the same hypervisor host and are not a substitute for an independent backup. We recommend that customers maintain their own backup strategy.

Suspension & Termination

We may suspend or terminate the services in whole or in part, with or without notice, for: non-payment, breach of these Terms, legal compulsion, or risk to the integrity of our network or other customers. Upon termination, your data may be retained for up to 14 days and then irreversibly deleted.

Disclaimer of Warranties

The services are provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the maximum extent permitted by law, our aggregate liability arising out of or relating to the services shall not exceed the fees you paid to us in the three (3) months preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages, or for loss of profits, data, or goodwill.

Governing Law

These Terms are governed by the laws of the Hong Kong Special Administrative Region. Disputes shall be submitted to the exclusive jurisdiction of the Hong Kong courts.

Changes

We may update these Terms from time to time. Material changes will be announced in the customer portal at least 14 days before they take effect. Continued use of the services after the effective date constitutes acceptance of the revised Terms.
